Editorial fair use

Junk Wax Museum publishes card images, brand names, set names, and player names as part of editorial commentary, criticism, historical scholarship, and news reporting about the 1984 to 1993 trading card era. This use is intended to fall within the protections of fair use under 17 U.S.C. §107 and nominative fair use of trademarks. All rights in the underlying works, marks, and likenesses remain with their respective owners. Junk Wax Museum does not claim ownership of any manufacturer's card artwork, brand marks, or player likenesses referenced on the site.

Takedown requests

If you are the owner of a copyright in a work that appears on this site, or an authorized agent, and you believe the material infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (17 U.S.C. §512). Junk Wax Museum honors properly formed takedown requests promptly.

How to file a DMCA notice

To be effective under the DMCA, your notice must be a written communication that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of the works.
  3. Identification of the material that is claimed to be infringing and its location on the site, sufficient to permit the material to be located. A direct URL is preferred.
  4. Information reasonably sufficient to permit contact with the complaining party, such as an address, telephone number, and, if available, an email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Response

A properly formed takedown notice will typically be reviewed within seven business days. Material determined to require removal will be taken down promptly and the submitter of the material, if not the copyright owner, will be notified. Junk Wax Museum reserves the right to evaluate whether the use in question qualifies as fair use before removing material.

Counter-notice

If material of yours has been removed and you believe the removal was in error, you may submit a written counter-notice to the designated agent above that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court for the judicial district in which you reside, or, if you are outside the United States, any judicial district in which Junk Wax Museum may be found, and a statement that you will accept service of process from the party who filed the original notice, or an agent of that party.

Repeat infringers

In accordance with 17 U.S.C. §512(i), Junk Wax Museum has a policy of terminating, where appropriate, contributors and users who are repeat infringers.

Bad-faith notices

Please note that under 17 U.S.C. §512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages. Consider whether the material in question qualifies as fair use before submitting a notice.
